I- INTRODUCTION The near universal ratification of the UN Convention on the Rights of the Child (CRC) provides the foundations for improving the situation of children around the world. Yet, millions of children are far from being able to claim and enjoy their rights. Worse still, for many children the violation of their rights happens on a daily basis. The Kingdom of Cambodia ratified the Convention on the Rights of the Child (CRC) in 1992 and consequently is obliged to report on the compliance with the CRC. The Initial report of States parties was submitted to the Committee on the Rights of the Child (the Committee) on 18 th December 1997 and the 2 nd and 3 rd Periodic Report of States parties was submitted to the Committee on 12 th March 2009. Following the due date from the Committee, the Kingdom of Cambodia will submit their 4 th , 5 th and 6 th Periodic Report of States Parties on 13 th May 2018. The Committee is composed of eighteen independent experts who are elected by States parties to the CRC. The Committee members serve in their personal capacity for four-year terms and can be re-elected. The CRC requires that Committee members have “high moral standing and recognized competence in the field covered by this Convention” (art. 43(2)). An equitable geographical distribution and representation of the principal legal systems is taken into consideration in their election 2 . A rights-based, equity-focused Situation Analysis of Children’s Rights includes: a dis aggregated assessment of the status of and trends in the realization of children’s and women’s rights; an analysis of the immediate, underlying and structural causes of shortfalls and disparities across various groups; and policy and programmatic recommendations to address the shortfalls and disparities and accelerate progress towards development goals and the fulfilment of human rights conventions 3 . By focusing on the key knowledge gaps related to inequities and child deprivations and promoting the broad engagement of all stakeholders, the Situation Analysis of Children’s Rights is intended to make an important contribution to shaping national development strategies to accelerate achievement of the child-related goals with equity. NGOCRC, with funding support from Save the Children, will recruit a consultant to lead the process of developing a Situation Analysis of Children’s Rights in 2017. II- OVERALL OBJECTIVE: o The purpose of this consultancy is to develop a Situation Analysis of Children’s Rights in 2017 based on the five clusters of the CRC and following up the implementation of the Concluding Observation from the Committee. The Situation Analysis will inform the policies and programs developed by the government and Child Rights Focused Organizations, as well as inform and contribute to the the development of the Alternative Report on the Implementation of the Convention on the Rights of the Child (CRC). The consultancy will be conducted under the supervision of the Program Coordinator of the NGOCRC. III-SPECIFIC OBJECTIVES: - To improve the understanding of decision-makers, development partners and other stakeholders of the current status of children’s rights in the country and of the causes of shortfalls and inequities, in order to inform recommendations for further actions; - To support national and decentralized planning and development processes including influencing policies, strategies, budgets and national laws to contribute towards an enabling environment for children that adheres to human rights principles, particularly concerning universality, non- discrimination, participation and accountability; - To contribute to national research on disadvantaged children and leverage NGOCRC’s convening power to foster and support knowledge generation with development, civil society and private sector stakeholders. - To strengthen the knowledge base to enable assessment of the contribution of development partners, including NGOCRC and its members, in support of national development goals. IV- DELIVERABLES: - Submission of a Situation Analysis of Children’s Rights in 2017 with supporting documents (in Khmer and English); - Submission of the weekly progress reports - Presentation of initial finding to NGOCRC’s Staff and task force team - Submission of the consultation workshop report on a Situation Analysis of Children’s Rights in 2017 (in English); - Submission of the dissemination workshop report on a Situation Analysis of Children’s Rights in 2017 (in English). V- METHODOLOGY: - Data collection and review: Conduct data collection and a review of available data and information, including data from the NGOCRC’s Children’s Rights Monitoring System, to accurately identify trends, patterns, incidence and causes of key deprivations (e.g. child mortality, stunting, low levels of birth registration, low school enrolment and achievement or violence against children), disaggregated by relevant segments of the population. - Consultation Workshop: Conduct a one-day consultation workshop with children groups, children and youth networks, CSOs and government agencies to explore and identify trends, patterns, incidence and causes of general trends within the situation for children in Cambodia. - Focus Group Discussion with children groups, children and youth networks, local authorities at all levels and other key stakeholders to indicate the progress that has been made by relevant stakeholders to promote children’s rights in Cambodia, identify gaps within ensuring the rights of all children in Cambodia and suggest strategic and policy recommendations. - Key Informant Interviews with government representatives at national level, NGOCRC’s members and CSOs working with children’s rights in Cambodia to indicate the progress that have been made by relevant stakeholders to promote children’s rights in Cambodia and to identify gaps within ensuring the rights of all children in Cambodia - Conduct a national dissemination workshop: A half-day dissemination workshop will be conducted with children groups, children and youth networks, CSOs, other development partners and government agencies to disseminate findings and improve the understanding of actors present of the current status of children’s rights in the country and the causes of shortfalls and inequities, in order to inform recommendations for further actions. VI- SCOPE OF WORK: The focus is on a general analysis of the realisation of children’s rights in Cambodia to enable to understand the situation and to develop strategies to enhance children & rights. The CRSA will comprise: 1. Mapping of violations of children’s rights (including gaps in provision) 2. Causality (or Problem) analysis – an examination of the immediate and root causes 3. Responsibility/stakeholder analysis – who are the duty bearers & what are they and other actors doing? 4. External analysis of what may help or hinder the realisation of children’s rights The CRSA will have a special focus on: Child participation – inclusion of information that is coming directly from children, including the most marginalized, about the violation or realization of their rights (both generally and in sectors). An analysis of children’s enjoyment (or not) of their participation rights (right to be heard in decisions that affect them (article 12), freedom of [removed]art.13); article 14 – freedom of thought, conscience, religion; article 15 – freedom of association; article 16 – right to privacy etc. Non-discrimination/diversity: The analysis will address the following questions: - Which groups of children experience discrimination? (Data should be disaggregated according to age; gender; disabilities; ethnic, religious, cultural or linguistic minorities; caste; infected or affected by HIV/AIDS etc.) - The impact of discrimination on children’s enjoyment of their rights. (taking into account multiple impacts of discrimination (For example the impact on access to education for girls with disabilities?) Legal & administrative frameworks: An analysis of the national and sub-national legal and administrative frameworks, and their functioning in practice. A rights-based, equity-focused Situation Analysis of Children’s Rights in 2017 should seek to respond to the following questions, either through direct consideration, or through reference to other documents in which these questions are adequately addressed: ** Key mapping questions: - How do child and maternal outcomes and trends differ across population groups and regions? - Which are the most deprived groups of children and women? Where are they located? - What forms of deprivation and exclusion do these groups face? What are the determining factors that give rise to and perpetuate their exclusion? - What are the immediate, underlying and structural barriers and bottlenecks to child and maternal well-being and to accessing and utilizing basic social services and other critical resources? - What existing social, institutional and political factors (e.g. social norms, institutional capacities at all levels of government, accountability and coordination mechanisms, policy and legal frameworks) impede or could potentially support the creation of an enabling environment for the realization of children’s rights? - Have the ‘drivers’ of inequity changed over time? If so, how has that been accomplished? If not, why not? Does the policy environment proactively address disparities and deprivations through legislation, policies and budgets? What gaps are there in policy response and in implementation? - What capacities exist at national, sub-national and community levels to participate in analytical processes that examine the causes and consequences of shortfalls and inequities? - What program interventions and resource mobilization and allocation options should be considered in the future, in order to address specific dimensions of inequity and pervasive vulnerabilities? The consultancy is proposed to commence in Mid-November 2017, lasting for a total of 30 working days. The consultancy is to be finalized by 25 th December 2017.The main tasks of the consultant are: - Meet with NGOCRC’s Staff and task force team to prepare the mapping and collection of data (1 day) - Conduct a desk review and meet with NGOCRC’s staff to develop the inception report which will inform the development of the Situation Analysis of Children’s Rights in 2017 - Field Consultation with children groups, children and youth networks, CWCC, DWCC, PWCC, CNCC, NGOCRC’s members, and other Children’s Rights Focused Organizations to collect their input and feedback on trends, patterns, incidence and causes of general trends within the situation for children in Cambodia (8 days) - Extract and analyze the data from NGOCRC’s Child Rights Monitoring System (4 days) - Compile a draft of the Situation Analysis of Children’s Rights in 2017. (5 days) - Conduct a one-day consultation workshop with NGO coalitions, NGOCRC’s staff, Children and Youth and relevant ministries, international NGOs, UN Agencies working to promote Children’s Participation to gain feedback and comments on the draft Situation Analysis of Children’s Rights in 2017 (3 days) - Finalize the Situation Analysis of Children’s Rights in 2017 in English and Khmer versions including an appendix with supporting documents. (3 days) - Conduct a half-day national dissemination workshop with children groups, children and youth networks, CSOs, other development partners, and government agencies to disseminate and improve the understanding of decision-makers, partners and all other stakeholders of the current status of children’s rights in the country and the causes of shortfalls and inequities, in order to inform recommendations for further actions. (2 days) VII-CONSULTANT QUALIFICATION: One qualified independent consultant (local and/or international) will be recruited. The minimum qualifications and experience required are: - A Master’s Degree in Social Sciences, Development Studies or MDS - Knowledge and experience of the Cambodian context, other Asian countries and/or the UN Human Rights Mechanism and System will be an asset; - Proven experience within conducting research, analytical studies and writing reports, as well as having good knowledge of Children’s Rights, Child Participation, Community Based Child Protection and Child Participation mechanism at various levels; - Experience of developing and evaluating the key quality element of children’s rights, child participation and child protection; - Experience of developing programs/projects and action plans for governments and CSOs related to child participation; - Familiar with application of cross cutting themes such as gender and disability mainstreaming, and monitoring and valuation skills; - Good spoken and written communication skills in English; - Excellent analytical and report writing skills; - Cannot have any history of child abuse and should SAY NO TO CHILD ABUSE. VIII-BUDGET The fee for this consultancy will be estimated and proposed by the applicant, and bidding will be conducted among the short-listed applicants. The consultant is expected to utilize the proposed funds to cover every aspect of the consultancy, including: tax payment, necessary travel and accommodation expenses, consultancy fee, team member salaries, per-diems, updating of DBMS, etc. NGOCRC will not be responsible for any additional costs accrued by the consultant.
